Title: Federal Appeals Court Temporarily Halts California Gun Law, Citing Second Amendment Infringement
In a major setback for gun control proponents, a federal appeals court has placed an injunction on hold for a California law that aimed to restrict gun owners from carrying firearms in various public spaces. The law, signed by Governor Gavin Newsom in September, was set to take effect on New Year’s Day. However, legal challenges have temporarily suspended its implementation.
Gun owners and several gun rights organizations filed a lawsuit against the law, arguing that it violates the Second Amendment of the United States Constitution. The injunction was issued by U.S. District Judge Cormac Carney, who described the law as “sweeping” and “repugnant to the Second Amendment” in his ruling.
The controversial law prohibits gun owners from carrying firearms in 26 different types of “sensitive” places. Additionally, it restricts concealed carry in privately owned businesses open to the public, unless the owner explicitly permits concealed guns by posting a sign. Critics argue that these measures infringe on gun owners’ rights and hinder self-defense.
The 9th U.S. Circuit Court of Appeals has issued an administrative stay on the injunction, effectively postponing the law’s enforcement until another panel of judges evaluates whether a more extended hold is necessary. This decision comes shortly after the U.S. Supreme Court’s ruling against a similar law in New York back in June 2022.
California Democrats contend that the newly contested law complies with the Supreme Court’s ruling in New York, but opponents argue that it merely attempts to bypass the high court’s verdict. The California Rifle and Pistol Association’s president criticized the state’s efforts to circumvent the Supreme Court’s ruling, while California Secretary of State Rob Bonta has vowed to appeal the temporary injunction.
Meanwhile, Governor Gavin Newsom has expressed his support for the state’s gun laws and remains committed to implementing measures that prioritize public safety. Notably, the California Rifle & Gun Association has not yet commented on the recent court ruling.
